Text messaging terms

These are the terms and conditions for text messaging on business phone lines operated by Danny Avila Agency (Daniel Avila), based in Vista, California. By texting one of our business numbers, by enrolling as a service professional, or by replying to a partner outreach message, you agree to them.

1. The programs

The agency runs three separate text messaging programs on three separate sets of phone numbers. They do not share numbers and they do not share lists.

Program A: business line relay

The agency operates local business phone numbers for the home-service brands it manages. This program connects a customer who texts or calls one of those numbers with the contracted service professional who handles that work. Customer messages are relayed to the professional, and the professional's replies are relayed back to the customer through the same business number. The account owner also receives operational notices about these lines. No marketing, promotional, or bulk messaging is sent through this program.

Program B: contractor lead partnership

The agency owns home-service websites that generate inbound calls from homeowners, and contracts one licensed local contractor per trade to receive those calls. This program is the text conversation with a contractor about that arrangement. It sends from a single dedicated number, (858) 400-4340, which is never used as a customer-facing business line.

Every recipient on this program has given their mobile number and agreed to be texted, either through the form at dannyavila.com/lead-partners or by contacting the agency first and asking to be texted. Nobody is added any other way. Message frequency is low and irregular, in short bursts when the agency is placing a trade and long quiet periods between them.

Program C: business-to-business partner outreach

The agency owns home-service websites that generate inbound calls from homeowners, and it needs one licensed local company per market to take them. This program is the first contact with a company that has not heard from the agency before. It sends from a dedicated number in the market being served, currently (901) 669-6535 for Memphis, which is never used as a customer-facing business line.

Every recipient on this program is a business, not a consumer, and every number is the main business line that company itself publishes on its own website and Google Business Profile for the express purpose of receiving inbound business inquiries. No number comes from a purchased, rented, or scraped consumer list, and no residential or personal mobile number is ever texted on this program.

A company receives one short introductory message. It identifies Danny Avila by name, names the website being offered, and asks a single question. If nobody replies, nothing further is sent to that company. If the owner replies, the exchange continues as an ordinary two-way business conversation. Every message carries STOP instructions.

2. How consent works

Program A. Customers join a conversation by texting or calling one of our business numbers first. Everything a customer receives after that is a reply within the conversation they started. Service professionals enroll by providing their mobile number directly to the agency and replying YES to an enrollment text, documented at dannyavila.com/sms-consent. Consent to receive texts is never a condition of any purchase.

Program B. A contractor opts in by submitting the form at dannyavila.com/lead-partners, where they enter their own mobile number and tick a box that reads: "I agree to receive text messages from Danny Avila Agency at the mobile number above about lead partnership and the calls these sites generate. Message frequency varies. Message and data rates may apply. Reply HELP for help or STOP to stop. Consent is not a condition of any purchase." That submission is the consent record. A contractor who calls or emails the agency first and asks to be texted is enrolled the same way, with the request kept as the record. Consent is never a condition of any purchase, and no number is ever added from a purchased, rented, or scraped list.

Program C. This program is business-to-business outreach, so it does not rely on a prior opt-in. A company is contacted only at the business line it publishes itself to receive business inquiries, only once, and only about a business arrangement. It is never used to reach a consumer, and no number on it comes from a purchased, rented, or scraped list. A single STOP, or a plain-words request, removes that company permanently.

Reply STOP at any time, or say in plain words that you do not want messages, and that number goes on a permanent do-not-contact list across every number the agency operates.

3. Message frequency

Program A frequency varies with customer inquiry volume. Program B is low and irregular, in occasional short bursts with long quiet periods between them. Program C is one message per company, and nothing more unless that company replies. No program has a fixed cadence and none of them send recurring scheduled messages.

4. Cost

The agency does not charge for text messages. Message and data rates may apply, depending on your carrier and plan.

5. Opting out

Reply STOP to any message to opt out at any time. You will receive one final confirmation that you have been unsubscribed, and nothing further. Reply START to resubscribe.

6. Getting help

Reply HELP to any message, or send a message through the contact form, and I'll take care of it personally.

7. Privacy

No mobile phone numbers, message contents, or opt-in consent records are shared with or sold to third parties or affiliates for marketing or promotional purposes. See the privacy policy and the text messaging policy for the full picture.

8. Carriers

Wireless carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier and network conditions.

9. Eligibility

You must be the authorized user of the mobile phone number you text from or enroll with.

10. Changes to these terms

If these terms change, this page changes first, and the date at the top moves. Continued use of the program after a change means you accept the updated terms.
